Terms of Use for clicID

Definitions
Clic Solutions AB (“Clic”) is the provider of the clicID-service or clicID.
The User is the one who registers in the clicID and creates an account. The User has gone through an authentication process so that clicID can be used for electronic identification and signing.
clicID is a service for electronic identification and signing that Clic provides to Users and Service Providers.
A Service Provider is a provider of services offered electronically (via mobile app or web) and is linked to clicID so that the User can use clicID for identification and signing.
Contractors or subcontractor to Clic deliver parts of clicID as agreed with Clic.
Terms of Use
1. These terms constitute an agreement between the User and Clic
- When the User accepts these terms, the terms apply as an agreement between the User and Clic.
2. About these terms
- Responsible for clicID is Clic Solutions AB, Swedish organization number 559087-2791.
- These terms do not apply to the Service Provider which uses clicID so the Users can use their clicID-app for identification and signing. This relationship is regulated in a separate agreement with the Service Provider and Clic.
3. Policies
- The User‘s Personal Data is handled in accordance with Clic‘s Personal Data policy.
- Current policies are available on Clic‘s website.
4. Conditions for becoming a User
- The User must create an account in the clicID
- To create an account and use clicID, the User must be at least 18 years old.
5. Registration
- For the User to be able to register in clicID and use it, the User must download the clicID
- The clicID app must be installed on a mobile phone, tablet, or equivalent unit.
- To use clicID, the User must digitally authenticate themself and create an account.
- Registration of the User requires a valid and personal email address/mobile phone number.
- Registration requires the User to register a six-digit personal PIN code.
6. clicID
- clicID has functions so that the User can do identification and signing via the clicID app at the Service Provider which has enrolled to the service.
- The features provided in clicID may change over time.
- In order for clicID to work, the User must have set all the necessary and correct settings.
- Clic may also offer new features in clicID that may be combined with special conditions. If the User wishes to activate these, the User must approve any additional terms for such services.
- The User is responsible for all obligations that arise when clicID is used by using a Service Provider´s services.
- The User is not responsible for obligations that arise after their clicID is notified to be revoked to Clic in the manner instructed by Clic and when Clic has informed that the revocation is completed.
7. Clic ‘s obligations
- Clic is responsible for having terms and policies that apply to clicID available on its website.
- Clic is responsible for checking the information that the User registers in clicID.
- Clic provides processes for revoking clicID.
- Clic shall immediately revoke clicID if the User so requests.
- Clic shall have available information on how the service is revoked on its website and in the clicID
- Clic is not responsible for any defects in the service caused by the Internet or otherwise communication service that clicID is transmitted over.
- Clic is not responsible for any defects in the service caused by the device that clicID is installed on.
- Clic is not responsible for defects or errors in the services provided by the Service Providers.
8. Costs
- The User‘s use of clicID is free of charge.
- Any traffic charges for communication may apply.
9. The User‘s obligations when registering
- The User is responsible for selecting a secure PIN code.
- The User is responsible for registering correct information only in clicID.
10. User’s obligations
- clicID is personal and shall not be used by anyone other than the User.
- clicID is to be regarded as a valuable document and the User is responsible for storing and handling it securely.
- The User is responsible for taking all necessary steps to keep their PIN code secret.
- The User is responsible for all use of clicID and that the clicID number with associated PIN code is protected against unauthorized access.
- The User is responsible for protecting their mobile device on which clicID is installed, against unauthorized use of clicID – and bears the risk and cost if any third parties have used it.
- The User is obliged to familiarize themself with how clicID works, the clicID functions, and what responsibility the User
- If the User discovers that a third party has gained access to the User‘s PIN code, then the User must immediately request Clic to revoke the clicID.
- In the event of loss of the mobile device on which clicID is installed, then the User must immediately request Clic to revoke the clicID.
11. Copyright and more
- clicID with all functions and data is subject to copyright, trademark, and/or other intellectual property rights.
- Clic provides the User with a non-transferable, non-exclusive license to use clicID on the devices, in accordance with what is stated in these terms. The terms govern all content, materials, or services available in clicID as well as updates provided by Clic that replace or complements the original service.
- It is not permitted to copy, modify, distribute or publish content provided by Clic.
- The User agrees that Clic may collect and use technical data and other related information, including, but not limited to, technical information about the User‘s device, system or application software, and peripherals. Such information is collected to improve clicID and to simplify the provision of software updates, product support due to the service. Clic may use such information, as long as it is in a format that does not identify the User personally, to improve the service and to provide services or technology to the User.
12. Permitted use of clicID
- It is only permitted to use clicID for your personal use.
- The User has the right to download and read the content in clicID.
- The User has the right to use clicID without paying any compensation only for the purposes outlined in these terms and in accordance with applicable law.
- The User may not use or allow anyone else to use the clicID for illegal or illicit means.
- Clic has the right to revoke or block the User‘s account or clicID
- If the User violates the terms of these User Terms.
- If Clic has reasonable cause to suspect that the User will break against these terms.
- Clic has the right to revoke or block the User‘s account and ClicID without any notice if Clic considers that there is a security risk which requires that.
13. Installation and updating of clicID
- The User is responsible for updating clicID in a reasonable time when Clic provides updates.
- Clic is not responsible for errors that occur in clicID or damages that occur due to failure to complete installation or update.
14. Errors or omissions in clicID
- In the event of a fault or deficiency in clicID, the User must contact Clic for action.
15. Force majeure
- Clic is not responsible for delays or losses due to circumstances that Clic or its subcontractors do not control, and which complicates the fulfillment of obligations or which means that the fulfillment of obligations is not financially defensible. Such circumstance may include but is not limited to strike, fire, epidemic, pandemic, war, natural disaster.
16. Breach of terms and Liability
- Clic has the right to suspend a User and revoke their account at any time
- if the User violates these terms
- if the User‘s ID document used in registration is not valid
- if the User through their use of clicID has caused damage to a third-party.
- The User must, when revoked, stop using the clicID and remove the app from the device where it is installed.
- Clic is not liable for damage in cases where clicID does not work properly due to
- Incorrect installation
- Improper use
- Improper handling
- Third-party acting or failure for which Clic has no responsibility, for example, communication services and more.
- Clic is not liable for damage caused by Clic having to revoke a clicID and nor on incorrect grounds provided that Clic has evaluated the cause of the revokation as reasonable.
- Clic is not liable for losses in business operations.
17. Change of Terms of Use
- Clic has the right to change these terms.
- Clic shall notify the User when changing these terms and shall if necessary or, where applicable, give a time limit before they take effect.
- If the User does not accept the changed terms, the User has the right to terminate the agreement with Clic before the amended terms enter into force.
- If the changes to the terms are necessary due to legislation or other similar reasons, Clic may make changes to the terms that become effective immediately.
18. Modification of clicID
- Clic has the right to change clicID or stop providing it.
- Clic must notify the User when changing the service and possibly a schedule for this.
19. Exit (Unregister)
- The User can terminate their account and revoke the use of clicID at any time.
- Termination of account and revocation must always be done according to current instructions.
- Current instructions for closing an account can be found on Clic‘s website.
- Upon termination of the account and revocation, all of the personal data linked to the account is either deleted or de-identified.
20. Right of withdrawal, applied law, and dispute
- The User is aware that the right of withdrawal does not apply after downloading and registering clicID.
- Swedish law shall apply to these terms.
- In the event of a dispute between Clic and the User, the parties shall in the first instance try to resolve the dispute through agreement.
- Disputes must be decided by a Swedish court.
